Please read the following information carefully. Your placement of an order constitutes a binding acceptance of these terms and conditions.

1. Product Authenticity & Natural Materials

When purchasing a memorial, the purchaser acknowledges that granite and marble are products containing natural materials. Stones may have variations in color, texture, and characteristics. Please note that while most in-stock items are pictures of the actual stone you will receive, variations primarily apply to special order items.

2. Pricing, Payment, and Cancellations

• Payment: We accept checks, money orders, and credit/debit cards via PayPal.
• Price Errors: We reserve the right to refuse or cancel any order resulting from a typographical error. We manually confirm every order to ensure accuracy.
• Cancellations: You may cancel your order for a full refund within 24 hours of payment. After this window, production and administrative costs may apply.

3. Returns and Restocking

• Non-Personalized Items: Memorials without personalized engraving may be returned within 10 days of delivery. Returns are subject to a 25% restocking fee. The customer is responsible for all original and return shipping charges.
• Custom/Personalized Work: Because personalized memorials are custom-made to your specifications, they cannot be returned or refunded once engraving has commenced.

4. Shipping & Damage Protocol

While our transit damage rate is less than 1%, the heavy and fragile nature of stone requires strict adherence to the following delivery protocol:

Any memorial damaged in transit (and noted as such on the delivery paperwork) will be replaced with the same memorial originally ordered. Once the memorial is signed for in good condition, Headstonesusa.com is no longer responsible for damage occurring during subsequent handling or site placement.

5. Cemetery Rules & Approval Assistance

The purchaser is responsible for verifying size, color, and material requirements with the destination cemetery. However, we are happy to assist you in this process. If assistance is needed, we can help you obtain the necessary approvals from the cemetery to ensure the memorial meets their specific bylaws before we begin production.

6. Privacy Policy

Your privacy is vital to us. Your data is protected by secure servers and processed via PayPal’s encrypted gateway. We do not trade, sell, or furnish any of your personal information (including email addresses) to third parties. Information is used solely for order fulfillment and essential communication regarding your purchase.

7. Jurisdiction and Venue

Any legal action brought against Headstonesusa.com shall be governed by the laws of the State of Illinois (Macoupin County) without regard to its conflict law principles. You agree that the sole jurisdiction and venue for any litigation shall be the appropriate Federal or State Court in Macoupin County, Illinois.
